Senator Schmitt’s ENABLE Act secures permanent savings protections for people with disabilities

U.S. Senator Eric Schmitt’s legislation, the Ensuring Nationwide Access to Better Life Experience (ENABLE) Act, has been signed into law as part of the One Big Beautiful Bill. The new law makes permanent several provisions related to Achieving a Better Life Experience (ABLE) accounts that were set to expire at the end of 2025.

There are currently more than 162,000 ABLE accounts in use across the country. These accounts allow individuals with disabilities and their families to save and invest money tax-free without losing eligibility for federal programs such as Medicaid and Supplemental Security Income (SSI).

“Individuals with disabilities and their families deserve stability and financial security as they invest and plan for the future. My legislation, the ENABLE Act, provides much-needed certainty to families and Missourians with disabilities by permanently expanding key provisions in ABLE accounts that incentivize and promote savings and investments opportunities without jeopardizing the federal assistance they need. I am grateful for the immense support my effort has received and was extremely proud to see President Trump sign it into law as part of the historic One Big Beautiful Bill,” said Senator Schmitt.

Three main ABLE account provisions were due to expire at the end of 2025 but are now permanent under this law:

- The “ABLE to Work” provision allows employed individuals with disabilities to contribute an additional amount each year to their ABLE account. This extra contribution is capped at either the previous year’s federal poverty level for a one-person household ($15,060 in 2024) or the beneficiary’s annual compensation.

- The “ABLE Saver’s Credit” gives individuals with disabilities who make qualified contributions to their ABLE account access to a nonrefundable saver’s credit of up to $1,000.

- The “529 to ABLE rollover” provision permits rollovers from a 529 education savings account into an ABLE account within annual contribution limits without incurring income tax.

Since these accounts were established, participants have collectively saved $1.74 billion per year through them.

Missouri State Treasurer Vivek Malek expressed support for the ENABLE Act: “As administrator of the Missouri Achieving a Better Life Experience (MOABLE) Program, I applaud Senator Schmitt for championing the ENABLE Act. This commonsense legislation will help break down barriers that have too often prevented individuals with disabilities from fully accessing the benefits of employment. By allowing employers to contribute to ABLE accounts in lieu of traditional retirement plans, the ENABLE Act ensures that workers with disabilities are not forced to choose between meaningful employment and critical federal benefits. It recognizes that financial independence should never come at the cost of security. This is a tremendous step forward for families across Missouri—and for the thousands of MOABLE participants who rely on this program to build a more stable future. I thank Senator Schmitt for his leadership and look forward to working together to expand the impact of ABLE in our state and across the nation.”

The ENABLE Act has gained support from numerous organizations including Autism Speaks, Edward Jones, National Down Syndrome Society, Microsoft, Muscular Dystrophy Association, National Disability Institute, National Federation of the Blind, various Down syndrome advocacy groups nationwide, among others.
