A Kansas City, Missouri man has been sentenced in federal court for crimes related to machineguns and conversion devices known as “switches.” Davorian M. Fleming, 21, received a sentence of 37 months in prison from U.S. District Judge Beth Phillips on September 9, 2025.
Fleming pleaded guilty on April 3, 2025, to possession and transfer of machineguns. He admitted that the switches were classified as machineguns and acknowledged his role in assisting co-defendants with transferring these weapons.
One co-defendant, K’Orion A. Duff, 23, also from Kansas City, was previously sentenced to 15 months in prison for distributing machinegun conversion devices. Two additional co-defendants are awaiting sentencing.
Federal law prohibits the possession or transfer of a machinegun as defined by Title 26, United States Code, Section 5845(b). This definition includes conversion devices commonly called “switches,” which can modify semi-automatic firearms to operate as fully automatic weapons.
The case was prosecuted by Assistant U.S. Attorney Ashleigh Ragner and investigated by the Bureau of Alcohol, Tobacco, Firearms, and Explosives.
According to the Department of Justice’s Operation Take Back America initiative, this prosecution is part of a broader effort targeting illegal immigration and violent crime through coordinated use of resources from programs such as the Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN).
